EOM Sang Phil
The Honorable Justice EOM Sang Phil was born on December 1, 1968, in Jinju, Gyeongsangnam-do Province. Justice Eom passed the 33rd National Judicial Examination in 1991 while attending the Seoul National University, College of Law. He then began his judicial career as a judge of the Seoul District Court in 1997. He has served as a judge in various courts, including the Seoul Family Court, the Chuncheon District Court Gangneung's Branch Court, the Seoul High Court, and the Seoul Central District Court. Justice Eom has served as a presiding judge of the Changwon District Court Jinju Branch Court, the Busan High Court in Changwon, and the Suwon High Court. He has also served as a research judge and presiding judge at the Supreme Court and as a professor at the Judicial Research and Training Institute. Justice Eom was appointed to the Supreme Court on February 29, 2024, while serving as the presiding judge of the Seoul High Court.
Throughout his 27-year judicial career, Justice Eom has been dedicated to upholding fundamental rights and protecting minorities. He believes that sincerity should be the basis for the handling of legal disputes. He is known for being considerate of parties when presiding over trials and striving to make a fair decision based on his deep understanding and reflection of people and society. During his service on the bench, Justice Eom has been named a 'top-rated judge' three times by district bar associations. This recognition, which is awarded on the basis of judicial excellence, is a testament to his exceptional judicial skills and has contributed to enhancing public confidence in the judiciary.
With his expertise, particularly in criminal law, Justice Eom has made significant contributions to the Korean judicial system. He has emphasized the importance of judges' self-reflection to ensure that they fulfill their duty to be prudent in deciding each case. His rulings have consistently upheld the principles of the warrant requirement and due process which is enshrined in the Korean Constitution and the Korean Criminal Procedure Act. Previously, while serving as a warrant judge at the Seoul Central District Court, he developed specific criteria for handling warrants in criminal cases, which were made available to judges throughout the country, thereby enhancing the efficiency and effectiveness of the judicial process.
