[1] Method of determining whether a collaborative act restricts competition in the market prescribed under Article 19(1) of the Monopoly Regulation and Fair Trade Act and whether such act also stimulates competition in the market [2] Where the Plaintiff and six other drug wholesalers, on the day after Ulsan University Hospital¡¯s bidding, agreed that the bid-winning wholesaler would purchase drugs based on the bid price from another wholesaler that had been trading with an existing pharmaceutical company, and that upon receiving payment from the relevant hospital, it would remit the amount based on the bid price to the relevant wholesaler, the case holding that the said agreement unfairly restricted competition in the bidding market
