[1] Purport of Article 5(2) of the former Design Act [2] In the case where: (a) Company A petitioned for adjudication on registration invalidation against B, the holder of rights to the registered design as applied to an article described as ¡°synthetic foam plank for drawing board¡±; and (b) the Intellectual Property Trial and Appeal Board (IPTAB) rendered an adjudication dismissing Company A¡¯s petition, the case holding that the registered design constitutes a design that could have been easily created by a person who has ordinary skill in the art to which the design pertains by applying a pattern of granite, etc., which is a well-known form of natural material |
