In a case where an Army sergeant (¡°Defendant¡±): (a) having constantly felt that his superior and fellow soldiers of his unit behaved in a way that was seen as constituting ostracism and bullying; (b) was shocked to find sketches and scribbles on the back pages of daily border patrol logs depicting him as various cartoon characters; (c) prompting him to throw a hand grenade and fire several rounds with his rifle with the intent to kill all the soldiers in the barracks; (d) having then fled after killing and wounding senior and fellow soldiers; and accordingly, (e) was indicted on charges of murder and attempted murder, murder and attempted murder of a superior officer, theft and destruction of military supplies, and desertion from military service, the case holding that affirmed the judgment of the lower court upholding the decision of the first instance court that sentenced the Defendant to death
