[1] Requirements for a public official to claim monetary payment from the State in the amount equivalent to actual remuneration [2] In a case where Party A (a public official) and others, on the grounds that the State did not provide childcare service by establishing a childcare center in the workplace or entrusting a local childcare center to provide childcare service, sought payment of childcare allowance from the State by asserting that the State is obligated to pay the childcare allowance pursuant to Article 14(1) of the former Infant Care Act, the case holding that such claim for payment based on the aforementioned provisions is impermissible as it goes against the “statutory principle of working conditions of public officials” and the principle of payment of public officials’ remuneration based on the national budget (in which relevant remuneration items are appropriated) |
