[1] In case where the phone number for an outgoing call, etc. is stated in the advertisement information for the purpose of making profits which is transmitted to the addressee's telephone without a prior agreement, the standard for determining whether the user of the above phone number for an outgoing call, etc. constitutes ""the person who transmitted information"" or ""the person who allows other persons to transmit information"" under Article 67 (1) 1 of the former Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. [2] In case where the advertisement information for the purpose of making profits is transmitted to the addressee's telephone without a prior agreement, the standard for determining whether the registered name holder of phone number for a return call stated in the advertisement information constitutes ""the person who allows other persons to transmit information"" who is subject to disposition imposing a fine for negligence under Article 67 (1) of the former Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. |
